LENDING RATE of Pvt Banks are arbitarilty chosen n remain HIGH and DUPE OLD unsupecting Customers opting 4 Floating Rates:

RBI must find out, on what basis the diff pvt banks of our country is duping the old, loyal, nondefaulting house loan customers, who had opted for Floating rate of interest. And awareness campaign should start.

Just to simplify, for an example if a person has taken a home loan of say 10 lakhs for say 15 years at say 11% SAY 2 YEARS BACK, his rough EMI AT FLOATING RATE COMES TO 10000/-.Now this 11% has two components, one is RPLR i.e. Retail Prime Lending Rate and the other SPREAD. This RPLR is govern by Pvt Banks and is SUPPOSED TO BE RELATED to RBI LENDING RATE, and this is what will change for Floating customers (fair enough till now).The SPREAD component is what PVT Bank plays Dirty, this is Pvt Banks own perogative and is not passed automatically to old custmers. The Pvt Banks reduce this Spread to bring down the effective rate of interest, thereby to lure new customers with Discounted new low rates but the old customers are left high and dry. Repeated request by RBI Governor is failing into deaf years.

 The RBI has cut its short-term lending rate by 425 basis points in six steps since October2008 to support growth. The RBI also slashed the reverse-repo rate by 275 basis points since early December and brought down the cash reserve requirement by 400 basis points to 5 percent to keep credit flowing. But surprisingly this measures by RBI has not benefitted the old customers much. For example take HDFC Ban, its RPLR on 2005 was 10.5% and Spread was Plus 0.5 i.e. effective rate was 11%, now in 2009, this RPLR is 13.75% but spread for new customers is MINUS 4.5% i.e. effective rate is 8.75%.That means for old customer of HDFC his effective rate of interest is 13.75% Plus Plus spread of 0.5% = 14.25%, whereas for the NEW customer it is only 8.75%.

MY POINT IS IF ALL THIS PVT BANKS DOESNOT WANT TO PASS THIS BENEFIT TO OLD CUSTOMER, THEN WHY HAVE FLOATING AND FIXED SCHEME, HAVE ONLY ONE SYSTEM OF ACCOUNTING AND LOAN.

HOPE SOMEBODY WILL TAKE UP THIS CASE WITH RBI, wherein PVT Banks are duping unsuspecting. mostly ignorant customers.

‘Ferozepur police shielding kidnappers of RTI activist’

The police are shielding the culprits involved in the shocking kidnapping case of the activist-cum-lawyer Kiran Pandey, of Ferozepur, alleged Mr H.C. Arora, convenor of the RTI Users Association (Punjab, Haryana and Chandigarh Chapter).

In a letter written to the Director General Police of Punjab today, Mr Arora accused the Deputy Superintendent of Ferozepur, Jasvir Singh, for holding a “biased and directionless investigation”. Jasvir Singh is also the Investigating Officer of the special team set up for this case.

He demanded that the case be transferred to other “police officials of integrity”, or the RTI Users Association would seek CBI inquiry into the case.

Kiran Pandey was allegedly kidnapped on July 12, and later drugged and tortured for exposing corruption. He was later was found unconscious lying on a roadside near the police station in the cantonment area of Ferozepur on July 18.

In a complaint to the Suprintendent of Police, Ferozepur, the mother of Kiran Pandey, on an affidavit filed on July 13, had stated that a member of the Ferozepur Cantonment Board, Joginder Singh Jindu, and Junior Engineer Satish Kumar, were annoyed with Kiran Pandey as he had filed a number of RTI Applications for seeking some vital information regarding certain development projects undertaken by the Ferozepur Cantonment Board.

Mr. Arora in the letter to the DGP has accused that the Investigating Officer of deliberately not questioning the caller of the phone who first contacted sister of Kiran Pandey on July 13, a day after he went missing. Mr Arora further accused DSP Jasvir Singh of “not honestly recording the statement” of Kiran Pandey and threatening Kiran Pandey not to name the accused in his video statement.

“The manner of recording of the FIR and the contents thereof are unusual. They indicate towards a concerted attempt of the Ferozepur police to protect the main accused, Joginder Singh Jindu, whose name has been mentioned by Kiran Pandey in his video-recorded statement,” accused the letter.

RTI activist Krishna Kumar said: “It is a clear case of the influential people close to the power trying to intimidate the free flow of information to hide corruption. The whistleblowers should be provided protection by the authorities.”

Another prominent RTI activist Mr Hemant Goswami said the police and political mafia worked hand in glove in Ferozepur.

“If the culprits think that by threatening and kidnapping an RTI activist they would be able to hush up the corruption, then they are mistaken. We would flood their office with RTI applications from all over the country,” Mr Hemant Goswami asserted.

The RTI Users Association said it would also take legal recourse to solve the issue.

NRI faces wrath of CHB officials for seeking Information

An NRI had to face the wrath of the Chandigarh Housing Board officials when she sought information under the RTI Act. They even refused to take action on her complaint to remove encroachments on her land after she filed an RTI application.

“The Chandigarh Housing Board’s officials turned hostile after I filed an RTI application,” complained Mrs Geetu Vashishta, an NRI (Indian citizen) from Hong Kong, who had bought a CHB Flat in sector 47 last year. “They treated me as an enemy.”

Mrs Geetu Vashishta had bought the sector 47 flat last year and after taking possession she came to know of the encroachment of garage/parking space related to the house. She filed a complaint with the Chandigarh Housing Board in last July and she has been running from pillar to post to get the encroachments removed.

Since she did get any response from the Chandigarh Housing Board to her a year-long complaint to remove encroachments, she filed an RTI application on June 16, 2009, seeking copies of the detailed layout plan of garage/parking space related to her flat and the status of her complaint.

“The Public Information Officer of the Chandigarh Housing Board has not even bothered to intimate me as to what is happening with my RTI application,” said an anguished Mrs Vashishta. “It reflects how badly the Chandigarh Housing Board is treating the RTI Act.”

Now she has filed an appeal with the First Appellate Authority and approached Chandigarh Administrator General S.F. Rodrigues, urging him to take action against the erring the Chandigarh Housing Board employees.

Based on an earlier RTI application’s reply, Mrs Vashishta wrote to the Chandigarh Administrator General Rodrigues about the callous attitude of the Chandigarh Housing Board’s employees.

Mrs Vashishta rues: “It has been more than one year and nothing has come out.”In her letter to Chandigarh Administrator General Rodrigues, Mrs Vashishta wrote: “I request your kind intervention to help me get back my right to the place allotted to me in the name of justice.”

HC Arora, a senior High Court lawyer and prominent RTI activist said: “The Chandigarh Housing Board has never been a transparent authority. It is scared of parting with any information due to the corruption involved.”

Meanwhile, another city RTI activist R.K. Garg said the Chandigarh Housing has been behaving irresponsibly. “It’s a pity that Chandigarh Housing Board is not maintaining records properly,” fumes Mr Garg. “The blatant manner in which it is behaving raises doubts that it has a lot to hide from the public eye. The CHB must come forward to make its position clear before the city residents.”

CHB says no to No Objection Certificates’ information

After being refused information sought for bringing transparency in issuing of No Objection Certificate (NOC) for Sale by the Chandigarh Housing Board, a city resident, Krishna Kumar, today filed an appeal with the First Appellate Authority under the RTI Act 2005.

To streamline the NOC issuing process by the Chandigarh Housing Board, the applicant had filed an RTI application in public interest on June 24. He had sought information on the number of NOCs for sale issued within one month, within three months and within six months from the date of filing the application for NOC, during the last five years.

Following complaints from the public that issuing on NOCs were generally delayed and even issued out of turn, the applicant raised the question of priority in deciding the issuing of NOCs by the Chandigarh Housing Board. He sought information from the Chandigarh Housing Board on the criteria adopted for issuing the NOCs – questioning whether the NOCs were strictly issued on first-cum-first served basis, or they were also issued out of turn, besides other issues.

The Central Public Information Officer (CPIO), Chandigarh Housing Board refused to provide the information taking the plea that since the records were not created, they could not be supplied.

In his appeal to the First Appellate Authority Under RTI Act 2005, Mr Krishna Kumar insisted that he found the CPIO’s reply “unsatisfactory and misleading, which is in gross violation of the RTI Act.”

He said that he should be supplied detailed information as Section 4 (1) of the RTI Act 2005 clearly stated that “Every public authority shall maintain all its records duly catalogued and indexed in a manner and the form which facilitates the right to information under this Act… so that the access to such records is facilitated.”

“Issuing of NOC’s for sale is an area where a lot of underhand dealings take place,” said Mr Krishna Kumar. “What problem the Chandigarh Housing Board officials have in providing the information?” he asked.

He alleged that the Chandigarh Housing Board was denying information to hide corruption. Mr. Kumar had sought information on 10 points, of which the Chandigarh Housing Board supplied information on two points, denied information on 8 points.

Kumar said he faced a lot of harassment from Chandigarh Housing Board officials who had been adopting illegal ways to kill the RTI Act.

Communication to “DGP - Punjab” w.r.t. biased investigation by Punjab Police

SUBJECT: Protest against biased and directionless investigation by DSP, Ferozepur (Shri Jasbir Singh) into the shocking incident of kidnapping of Kiran Kumar Pandey, a RTI Activist, and Advocate of Ferozepur. 

Sir, 

I am pained to learn from Shri Kiran Kumar Pandey that the I.O. in this case (Shri Jasbir Singh, DSP) is acting in a totally biased manner and with a pro-accused orientation, which is clear from the following:- 

1.        The I.O. is well aware of the fact that the first phone call regarding Mr. Pandey having been kidnapped was received by the sister of Mr. Pandey on July 13th. in the morning from land line phone no. . 01632-235147, but the I.O. has not taken the said information seriously. It is pertinent to state that said phone no. 1632-235147 is registered in the name of one Shri Ashok Kumar, address-opposite-Bus Stand, Ferozepur. The I..O. is deliberately not examining this vital clue to kidnapping of Mr. Pandey.

 2.        The I.O./DSP did not act honestly while recording the statement of Mr. Pandey on July 18th. in Baghi Hospital, Ferozepur. As per Mr. Pandey, the statement of Mr. Pandey was recorded by Inspector Sarabjit Singh, in the presence of the I.O, but on several occasions, throughout the recording of Mr. Pandey’s statement, the DSP would raise his hand towards cameraman, at which the cameraman would stop video recording of petitioner’s statement.  Then, the DSP would threaten Mr. Pandey and tell him that he should not try to implicate Joginder Singh Jindu.  Such interruptions used to break the continuity of Mr. Pandey’s statement, but still he narrated the whole truth about the incident to the police officials.  The attitude of I..O., Shri Jasbir Singh reveals that he is acting in a biased manner and is trying to protect the accused persons.

3.        The manner of recording of the FIR No.56 of 16.7.2009, and the contents thereof are also unusual, and those indicate towards a concerted attempt of Ferozepur Police to protect the main accused, Shri Joginder Singh Jindu, whose name has been mentioned by Mr. Pandey in his video-recorded statement, besides the name of Mr. Satish Arora, J.E. For your information, an extract from the said FIR is reproduced hereunder to convince you that even the Police official, who recorded the complaint, was biased one and was acting at the behest of accused persons. The relevant portion of the FIR reads as under:-

“They (family members of Kiran Pandey)suspect that Kiran Pandey has been kidnapped and killed by Joginder Singh @ Jindu, President and Satish The people from the Mohalla and neighbourers of Kiran Pandey have stated in their statement that on that day at about 6/6.30 PM, Joginder Singh @ Jindu, President and Satish Kumar, J.E. Cantt. Board and other persons on motor cycles did not come to Kiran Pandey’s house and did not abuse. They are ready to say on oath that on 12.7.09, it being Sunday, Satish Kumar, J.E. has been proved to be at his residence during entire day.  On 12.7.09, Sh. Parkash Singh Badal, had come to the residence of Irrigation Minister Janmeja Singh Sekhon in connection with the bye elections at Jalalabad and Joginder Singh @ Jindu, President Cantt. Board has been proved to be present at the Kothi of Sardar Janmeja Singh from 4 PM to 11 PM.”

I, as convener of the RTI Users Association (Punjab, Haryana & UT Chandigarh Chapter), therefore, appeal to you to change the I.O. in this case, as he is acting in a totally biased manner, and is trying to protect the accused persons. Mr. Kiran Pandey and his family members rather suspect that the I.O. is trying to implicate them, instead of nabbing the real culprits/accused persons. I, therefore, appeal to you to transfer the investigation from Shri Jasbir Singh, DSP, Ferozepur to some other senior officer of proven integrity from some other District.

This is, however, without prejudice to our right to demand the transfer of investigation of this case to C.B.I., if your goodself is unable to ensure justice to the aggrieved Mr. Pandey and his family members.
