Programme on RTI captioned “Masle” (i.e., Issues/ Mudde) to be telecst on Punjabi News Channel “PTC News” on Monday at 8.30 P.M.

The above programme on issues and problems faced by the RTI users has been recorded this evening, and shall be telecast on PTC News Channel on Monday at 8.30PM. The panelists are (i) Rajan Kashyap, former Chief State Information Commissioner, Punjab; (ii) H.C. Arora, Convener of RTI Users Association, and (iii) Kanwaljit Singh, Advocate from the High Court. The issues discussed include (a) Protection to Whistle Blowers; (b) Role of RTI Users Association in the present scenario; (c) Bureaucratic attitude; (d) declaration of assets by SC Judges; (e) appointment of bold, fearless and honest Judges as Information Commissioners; (e) repercussion of disclosure of file notings on attitude of babus ; and (f) success of RTI in fight against corruption, etc.,etc.

SUBJECT: The Whistle Blowers (Protection in Public Interest Disclosures) Bill, 2006-Request for holding a meeting with our Association.

Dear Sir,

I understand that the above-mentioned Bill is still pending in the Parliament. I have perused the Bill very carefully, and am of the considered view that this Bill does not meet the aspirations of the Rights Activists. It appears that while drafting this Bill, the problems emanating from implementation of the RTI Act, 2005 have not been taken into account. The following serious short-comings in the pending Bill are apparent from a cursory glance at the Bill:-
The Bill aims at maintaining secrecy about the identity of the Whistle-Blower, while the identity of the applicant (whistle blower under the RTI Act) cannot be kept secret;

The punishment envisaged under Section 7 may be relevant for superior officers where the whistle blower is an employee, but in the case of kidnapping or murder of a Rights Activist, such a punishment of sentence would be completely irrelevant, as such sentence shall run concurrently with the sentence of imprisonment that may be otherwise imposed for murder or kidnapping;

I would, therefore, request you to discuss the various clauses of the Bill with our Association, on any date and time convenient to you, so that amendments in the Bill may be suggested to make it more effective, or in the alternative, a separate exclusive/ self-contained Bill may be introduced by the Government for protection of the people who blow whistle under the RTI Act for exposing corruption and misuse of powers by senior officers/ powerful persons.

Justice Pritam Pal,President, UT Chandigarh State Consumer Disputes Redressal Commission declares his assets

Responding to appeal made by H.C. Arora, Convener, RTI Users Association, Justice Pritam Pal (Retd. Judge, Punjab & Haryana High Court) has declared his assets, and has informed Arora through his Seretary, Mr. Raut, that the statement of his assets is being put on the offricial website of the State Commission; he has also offered Arora to provide him a copy of the statement, if he so desires. Justice Pritam Pal has given lead to all retired HC Judges who are holding important positions as heads of various Tribunals/ Commissions. It is to be noticed that Arora had only yesterday appealed to all the Retod. HC Judges who are holding positions as Chairman, PuNJAB human Rights Commn, Presidents of Punjab/ Haryana/ UT Chandigarh Consumer Commissions, Chief Information Commissioners, Punjab/ Haryana State Information Commissions, Chairman of recently established Punjab Educational Tribunal etc. to declare their assets by following the example of Judges of Supreme Court.

Kiran Pandey’s case

August 26th-

Justice A.G. Masih of the High Court has directed the SSP Ferozepur to examine all the grievances raised by Kiran Pandey in his representation dated 17.8.2009, and thereafter to take further appropriate steps in accordance with law. It may be worth mentioning that in his representation dated 17.8.2009, Kiran Pandey had, inter-alia, raised the issues that (i) the owner of the telephone from which the family members of Kiran Pandey received the first call on 13th July, regarding his kidnapping, should have been interrogated; (ii) The FIR registered by the Police which mentions “unknown suspects” against the column of “accused” should be amended and in view of the clear and categorical statement given by Pandey after his release by the kidnappers, the names of Joginder Singh Jandu and Satish Kumar Arora, JE, of Ferozepur Cantt. Board should be shown against the said column as accused; (iii) the Investigation team be changed and some senior officers from other district should be entrusted investigation especially in view of the fact that within the FIR itself, clean chit has been given to Joginder Singh Jandu and Satish Kumar Arora, JE by referring to names of Parkash Singh Badal and Janmeja Singh Sekhon, Cabinet Minister.
